Terms & Conditions

1. AusClub Pty Ltd (ABN 11 672 787 996) (AusClub, we, us or our) operates the AusClub platform, offering both one-time and VIP memberships. These terms and conditions apply to all memberships.

2. You must be at least 18 years old to sign up to an AusClub membership.

3. Membership of AusClub is subject to the terms of service that apply to the use of the AusClub website.

4. These terms and conditions are a binding agreement between us and each member of the AusClub platform. By signing up to an AusClub membership, you agree to these Terms of Service and our Privacy Policy. Please read these Terms of Service and Privacy Policy carefully before you purchase an AusClub membership.

ONE-OFF MEMBERSHIPS

5. One-time memberships provide short-term access to our services and the AusClub platform, tailored to your needs.

6. One-time memberships are available in four tiers, as follows:

7. Purchasing multiple one-time memberships, will accumulate and combine your days of access to the AusClub platform.

8. You may purchase both VIP and one-off memberships at the same time, however the access days from the one-off membership will not be used until after your VIP membership is cancelled or terminated.

9. If you purchase a one-off membership via a link that is advertised as part of an AusClub promotion (official link) during a promotion period, you will receive the set number of entries associated with that package as a part of that particular promotion.

10. For the avoidance of doubt, you will not receive entries into more than one promotion if you purchase a one-time package from an official link. If you would like to receive access to all AusClub member only promotions, then you must hold a VIP membership.

11. Entries into promotional draws are otherwise subject to the terms and conditions associated with the relevant promotion, which should be read in conjunction with these membership terms and conditions.

VIP MEMBERSHIPS

12. VIP memberships are ongoing subscriptions, billed continuously until cancellation by you or termination by us as per these terms and conditions.

13. VIP memberships are available in three tiers, as follows:

14. VIP members accumulate entries for each continuous month that they hold a membership. The number of entries are generated is based on your current VIP membership level. This means if you hold a VIP membership for six months and have changed your membership status from one membership level to another during that time, the total number of entries you receive in a draw will be calculated in accordance with the membership level you hold at the time of the entries being generated for a specific giveaway and the tiers you have had previously.

Example: If you hold a premium membership for four months you will receive 12 entries into a promotional draw. If you then decide to downgrade your membership to the entry membership for your fifth month and we generate entries for a promotion while you’re on the entry tier, you will only receive 5 entries. However, if you then upgrade back to the premium membership for your sixth month, and we generate entries for a promotion you will receive 18 entries for that promotion.

15. VIP membership entries into promotional draws are generated before the relevant promotion period commences. Please check the AusClub member portal via ausclub.com.au to view your entries. If your entries are not showing inside your portal, contact us at support@ausclub.com.au.

16. Entries into promotional draws are otherwise subject to the terms and conditions associated with the relevant promotion, which should be read in conjunction with these membership terms and conditions.

Upgrade or downgrade of VIP Membership

17. You can request to upgrade or downgrade your VIP membership at any time through you AusClub portal, however it will come into effect on your next billing cycle. No refund will be offered if you opt to downgrade your membership mid-billing cycle.

TERMINATION OF MEMBERSHIP

18. To cancel your VIP membership, please email support@ausclub.com.au. We will then provide you with a link where you will prompted with steps to cancel your membership. By cancelling, you this stops all future payments and removes the bonus accumulated entries from all future promotional giveaways.

19. Once the cancellation process is complete, your membership will be cancelled instantly, and you will be sent a confirmation email.

20. Cancelling your membership does not remove you from our mailing or text lists, please use the associated links as they are sent via third parties.

21. If payment fails, there will be 4 automatic attempts made to bill it over 20 days from the initial payment failure. After the final attempt, if there are inadequate funds, your subscription will be terminated, and your VIP streak will be lost.

22. You may re-subscribe to a VIP membership at any time. If you re-subscribe within 30 days of cancelling your VIP membership or your VIP membership being cancelled by us, you will retain all previous benefits you held under your VIP membership. However if you do not re-subscribe to a VIP membership within 30 days of cancellation or termination, any previous benefits you had as a VIP member will not carry over.

CHANGE OF DETAILS

23. You should notify us of any change of name, address, contact number, email address or billing information by updating your details online at www.ausclub.com.au, or by emailing us at support@ausclub.com.au.

24. We will not be responsible for any failure by you to notify us of your change of details, which may result in you not obtaining the full benefits of your AusClub membership.

MEMBERSHIP SIGN-UP BONUSES

25. Periodically, we may introduce incentives for new sign-ups, which could include bonuses, exclusive deals, or trial periods at no cost. The availability and validity of these incentives are governed by the specific terms and conditions set forth for each offer.

26. Should you engage with a no-cost trial offer and choose not to terminate it before its conclusion, we will proceed to bill the payment method you have designated in line with the stipulations of the VIP membership outlined previously. This billing will continue in a recurring manner until such time as you opt to terminate your membership in adherence to the stated terms and conditions.

GENERAL TERMS AND CONDITIONS

27. We are not responsible for any tax implications arising from you using the AusClub platform or receiving any benefit from it.

28. We may exclude or suspend you from the AusClub platform or from receiving benefits from the AusClub platform if you:

• engage in conduct that may jeopardise the proper conduct of the AusClub platform;
• act in a disruptive, annoying, threatening, abusive or harassing manner;
• do anything that may diminish the good name or reputation of us, our partners or any of our related entities or contractors;
• breach any law in connection with the AusClub platform or your participation in our promotions; or
• behave in a way that we reasonably believe is otherwise inappropriate.

29. You must not assign or attempt to assign any right or liability under these terms and conditions without our prior written consent.

30. Any term of these terms and conditions that is expressed to survive, or by its nature survives, the termination or expiry of these terms and conditions will survive and continue in effect following such termination or expiry.

31. All references to $ in these terms and conditions are in Australian dollars.

32. We may, from time to time, amend these terms and conditions. The amended terms and conditions will apply from the time they are posted on the AusClub website or are otherwise notified to members. If you do not wish to accept any amendments to these terms and conditions, you may cancel your AusClub membership.

33. We may cease offering memberships by notifying members on the AusClub website or otherwise, provided that we provide sufficient notice so that the termination does not cause unreasonable financial or other detriment to members.

34. These terms and conditions are governed by the laws of Western Australia.
